The U.S. Environmental Protection Agency (EPA) is determining under the Clean Air Act (CAA) that the Berrien County and Muskegon County, Michigan nonattainment areas have attained the 2015 ozone National Ambient Air Quality Standards (NAAQS). This determination, informally known as a clean data determination, is based upon complete, quality assured, and certified ambient air monitoring data for the 2023-2025 design value period showing that the areas achieved attainment of the 2015 ozone NAAQS. This clean data determination also relies upon the Michigan Department of Environment, Great Lakes, and Energy's (EGLE's) exceptional events request submitted to the EPA on December 26, 2025, and which the EPA concurred on January 12, 2026. As a result of this determination, the EPA is suspending the requirements for the Berrien and Muskegon areas to submit attainment demonstrations and associated Reasonably Available Control Measures (RACM), Reasonable Further Progress (RFP) plans, contingency measures for failure to attain or make reasonable progress, and other planning State Implementation Plans (SIPs) related to attainment of the 2015 ozone NAAQS for as long as the areas continue to attain the 2015 ozone NAAQS.

The Drug Enforcement Administration (DEA) is revoking the exempted status for certain nonnarcotic prescription products that are currently on DEA's Table of Exempted Prescription Products, but whose National Drug Codes (NDC) are inactive because they are no longer available and/or the company that applied for the exemption no longer exists. These products will be removed from DEA's Table of Exempted Prescription Products and will no longer be considered exempt prescription products under the Controlled Substances Act. This action does not impact exempted prescription products with active NDC numbers.

This final rule amends Marketing Order No. 989, which regulates the handling of raisins produced from grapes grown in California. The Department of Agriculture approves and adopts amendments proposed by the Raisin Administrative Committee (Committee) after due consideration of a public hearing record, and after California raisin producers voted in favor of such amendments in a referendum. This rule reduces the Committee membership size from 47 to 21, removes producer district representation and adds an unaffiliated producer member seat, eliminates the designated cooperative bargaining association member seat, and lowers quorum requirements from 25 to 14; removes the requirement for separate member and alternate member position nominations for independent and small cooperative producers; removes factor 4 and part of factor 5 for establishing marketing policy and adds language clarifying the quality of reconditioned raisins; and adds authority to accept voluntary contributions and language regarding ownership of intellectual property. In addition, this action makes necessary changes to the marketing order to conform to the amendments adopted.

The U.S. Environmental Protection Agency (EPA) is proposing to approve a revision to the Maricopa County Air Quality Department (MCAQD or "Department") portion of the Arizona State Implementation Plan (SIP). This revision establishes a federally enforceable program allowing nonroad engine fleet owners/operators to generate emission reduction credits (ERCs) by either retrofitting their nonroad engines or replacing their nonroad engines with lower-emitting nonroad engines while meeting other Clean Air Act (CAA or "Act") requirements. These ERCs are intended for use as offsets for major stationary sources under the Department's Nonattainment New Source Review (NNSR) program. We are proposing to approve a local rule to allow for the generation of ERCs through voluntary nonroad engine emission reductions under the CAA.

This proposed rule would amend the Clinical Laboratory Improvement Amendments of 1988 (CLIA) regulations to allow for virtual access under the CLIA certificate of the primary testing laboratory that generated the data, with the exception of the subspecialty of cytology, and the use of digital images for gynecologic cytology proficiency testing. This proposed rule also includes proposed changes to personnel qualification requirements and other proposed changes pertaining to SARS-CoV-2 reporting requirements, certificate requirements, test reporting requirements, enforcement requirements, public consultation requirements, and editorial and technical updates. These proposed updates aim to strengthen the Federal oversight of clinical laboratories and ensure accurate and reliable patient test results while adapting to modern technological capabilities and industry needs, including workforce shortages.

The Office of the United States Trade Representative (USTR) invites comments regarding the current and potential impact of the European Union's (EU) Carbon Border Adjustment Mechanism (CBAM) on U.S. producers, including small- and medium-sized producers; workers; U.S. direct and indirect exports; and overall U.S. trade with the EU. Under CBAM, EU importers of products covered by the CBAM (covered products) in the aluminum, cement, electricity, fertilizer, hydrogen, and iron and steel sectors are required to declare information on carbon dioxide and other specified greenhouse gas emissions generated in the production of imported goods and to purchase CBAM certificates based on the amount of that embedded carbon. The EU began the full implementation of CBAM on January 1, 2026. The EU is also considering legislative proposals to expand CBAM coverage to downstream steel- and aluminum-intensive products. USTR is seeking comments on the impact of the CBAM on U.S. trade with the EU, as well as the potential impact of the EU's proposals to expand CBAM coverage. Such comments will help inform continued USTR and U.S. government engagement with the EU on CBAM.

We are amending the regulations governing the importation of fresh cut flowers to remove requirements for the importation of specific types of cut flowers from the regulations, and to list them in the U.S. Department of Agriculture database called the Agricultural Commodity Import Requirements instead. We are also removing entirely any restrictions on the importation of fresh cut flowers of the genera Chrysanthemum, Leucanthemella, and Nipponanthemum from countries in which chrysanthemum white rust (Puccinia horiana P. Henn., CWR) is known to exist. This rule will allow us to use a notice-based, streamlined approach to update the import requirements for cut flowers and remove CWR-specific restrictions on the importation of fresh cut flowers.

The U.S. Environmental Protection Agency (EPA or Agency) is approving a State Implementation Plan (SIP) revision submitted by the State of Georgia through the Georgia Environmental Protection Division (EPD) on June 27, 2024. The revision removes permitting requirements related to nonattainment, including nonattainment new source review (NNSR), from Georgia's SIP as obsolete, removes certain provisions related to the use of emission reduction credits (ERCs), and makes other changes based upon the lack of any areas designated as nonattainment for the National Ambient Air Quality Standards (NAAQS) in Georgia. The EPA is approving these changes pursuant to the Clean Air Act (CAA or Act).

Pursuant to the Federal Clean Air Act (CAA or the Act), the U.S. Environmental Protection Agency (EPA) is approving portions of the State Implementation Plan (SIP) submittal from the State of Oklahoma demonstrating that the State satisfies the interstate transport requirements of the CAA for the 2010 1-hour sulfur dioxide (SO<INF>2</INF>) primary National Ambient Air Quality Standard (NAAQS). This provision requires each State's implementation plan to contain adequate requirements prohibiting the interstate transport of air pollution in amounts that will contribute significantly to nonattainment, or interfere with maintenance, of a NAAQS in any other State.
